General booking conditions

The parties to the contract: "we or the seller / You or the customer ".

The rental of our apartments is subject to the ordinary conditions of French law and to those set out below. Validation of the reservation implies acceptance of these general terms and conditions, and automatically entails the deduction of a corresponding 33% deposit by our establishment or, where applicable, and at the express request of the customer, the obligation for the customer to proceed with immediate payment of the 33% deposit by bank transfer. By clicking on the <> the customer validates and confirms his order, he is irrevocably bound.

Booking, validation and payment

All reservations are made exclusively either through a central reservation system (Booking, Gîtes de France, etc.) or through our own website, in which case they are made through a secure online reservation file, including the customer’s credit card details. Online booking validation is sent to us via the messaging tool included in the booking file. If the apartment is available on the dates requested, we will collect the corresponding deposit. Where applicable, the customer may choose to pay the 33% deposit by bank transfer. The reservation is firm only after receipt of the deposit, which is proof of the existence of the rental contract. If the deposit is paid by bank transfer, the reservation will be protected for the duration of the transfer, up to a maximum of 3 calendar days.

As soon as the deposit has been received, the customer will receive confirmation of the order, receipt of the deposit and a detailed invoice.

General comments

Validation of the booking, receipt of the deposit and confirmation from us of availability make the rental contract definitive; in the event of withdrawal, the customer is obliged to pay the rent in full, unless otherwise agreed in the contract.

In our case, and this is to be considered as a contractual arrangement, the balance is due one month before entry into the rental and will be debited by our establishment unless the customer has opted for payment by bank transfer; in this case, the transfer of the balance must reach us 30 days before entry into the rental. If the balance is not paid on time, the seller will send the customer a reminder by e-mail. If no response is received from the customer and the balance is not paid within a maximum of one week, the rental contract will be considered cancelled by the customer. In this case, the deposit will be retained by the seller and the apartment will be available for a new rental.

In the event of cancellation of the stay by the customer after payment of the deposit and/or balance, all sums paid remain the property of the customer. We strongly recommend that you take out cancellation insurance.

For bookings made less than 30 days before the start of the stay, the full price of the stay will be deducted by our establishment or must be paid to us by bank transfer within 3 calendar days of the booking.

Arrival and departure times
Arrivals are from 4pm. The deadline for departure is 10 a.m.
Insurance
The customer is responsible for all damage caused by him/her. He must be covered by a “holiday” type insurance policy for these various risks. Most home/apartment insurance policies include a vacation clause that covers this type of risk.
Lodging capacity

The contract is based on a capacity of one person. If the number of guests exceeds our capacity, we will refuse additional guests. Should this result in a breach of contract, it will be deemed to have been initiated by the customer. The sums paid will remain the property of the seller.

When booking, the customer must indicate the number of people accompanying him or her; no additional people will be accepted after the reception even if the total number of people is less than the reception capacity.

Pets
Pets are not allowed; any breach of contract will be considered to be at the customer’s initiative.
Inventory on arrival
The vendor or his representative greets the customer on arrival at the gîte. Together they check all the features of the furnished apartment: cleanliness, furniture, kitchen equipment, crockery, glassware, bedding, linen, etc.

This procedure acts as a contradictory inventory, with any anomalies recorded on the contact sheet, which acts as a contract, signed by both parties.

Any significant anomaly discovered subsequently must be reported to the seller within 12 hours and will follow the same procedure.

The customer is obliged to occupy the premises personally, to live in them “as a good father of the family”, to maintain them and to avoid any nuisance. Any repairs made necessary by negligence or poor maintenance during the rental period will be at the customer’s expense.

Security deposit - Leaving

The seller or his representative will carry out a joint inventory with the customer before his departure. Where applicable, the owner or his representative will be entitled to claim from the customer, on departure, the full value of the replacement cost of broken, cracked, chipped or damaged objects, furniture or equipment, and/or the cost of cleaning dirty blankets, comforters and cushions; similarly, the cost of restoring any damage of any kind to curtains, wallpaper, ceilings, carpets, floors, windows, bedding, etc. will be charged.

The sum of 33% of the total rental amount will be deducted by the vendor on the day of rental, following the discovery of any deterioration; this sum represents the security deposit. The seller will replace, clean and/or restore the above-mentioned unit as soon as possible.

If the amount of the expenses incurred exceeds the security deposit, we will deduct the remainder from the customer; if this amount is less than the security deposit, the difference will be refunded to the customer; an invoice for these expenses will be sent to the customer. The customer will be required to provide the seller with his credit card details prior to departure.

 

Most home/apartment insurance policies include a vacation clause to cover this type of risk.

Miscellaneous
The apartments are non-smoking. Smoking areas are available outside, in the garden, terrace and/or patio.

The customer may not object to a visit to the premises if the seller or his representative so requests.

The parties agree that the French language version of our general terms and conditions, offers and contracts on our website takes precedence over all translations into any other language.

The parties agree that the rental contract is governed by French law, including the definition of jurisdiction.
